Terms of Service

1. Agreement to these terms

These Terms of Service ("Terms") are a contract between you and Metatheory Inc. ("Atmos", "we", "us") governing your use of the Atmos Mind Gym app, this website, and related services (together, the "Service"). By downloading, accessing, or using the Service, you agree to these Terms. If you don't agree, please don't use the Service.

2. Who can use Atmos

You must be at least 13 years old (or the minimum age in your country) to use Atmos. If you're under the age of majority where you live, you confirm that a parent or guardian has reviewed and agreed to these Terms on your behalf.

3. Your account

• You're responsible for keeping your login credentials secure and for activity under your account.
• Provide accurate information when you sign up and keep it current.
• Tell us promptly at support@atmosgym.app if you suspect unauthorized use of your account.

4. The beta program

Some features are offered through a beta program (for example, via TestFlight). Beta features are provided "as is", may be unstable or change without notice, and may be removed at any time. Feedback you share about beta features may be used to improve the Service without obligation to you.

5. License to use the Service

We grant you a personal, limited, non-exclusive, non-transferable, revocable license to use the Service for your own non-commercial brain training. This license is subject to these Terms and does not transfer any ownership to you.

6. Acceptable use

You agree not to:

• Copy, scrape, resell, or redistribute puzzles, content, or any part of the Service.
• Reverse-engineer, decompile, or attempt to extract the source code or puzzle-generation logic, except where the law expressly permits it.
• Interfere with, overload, or attempt to gain unauthorized access to the Service or its systems.
• Use the Service to violate any law or the rights of others.
• Manipulate streaks, leaderboards, or progress through automated means.

7. Purchases and subscriptions

Atmos offers a free daily workout. Some features may require a paid subscription. Purchases are processed by the applicable app store (Apple or Google) under their terms, and billing, renewals, and refunds are handled according to that store's policies. Subscriptions renew automatically until cancelled through your app-store account.

8. Intellectual property

The Service, including its puzzles, software, design, the Atmos name, and the Wug character, is owned by Metatheory Inc. and protected by intellectual-property laws. Nothing in these Terms grants you any right to our trademarks or content beyond the limited license above.

9. Not a medical service

Atmos is a training and entertainment tool. It is not a medical device and does not diagnose, treat, or prevent any condition. Claims about "brain training" reflect our design intent, not a guarantee of specific cognitive outcomes. Consult a qualified professional for medical advice.

10. Disclaimers

The Service is provided "as is" and "as available", without warranties of any kind, whether express or implied, including fitness for a particular purpose and non-infringement, to the fullest extent permitted by law. We don't warrant that the Service will be uninterrupted, error-free, or that progress will always sync perfectly.

11. Limitation of liability

To the maximum extent permitted by law, Metatheory Inc. will not be liable for any indirect, incidental, special, or consequential damages, or for lost data or progress, arising from your use of the Service. Our total liability for any claim relating to the Service is limited to the greater of the amount you paid us in the prior twelve months or USD $50.

12. Termination

You may stop using Atmos and delete your account at any time. We may suspend or terminate your access if you violate these Terms or if we discontinue the Service. Sections that by their nature should survive termination (such as intellectual property, disclaimers, and limitation of liability) will continue to apply.

13. Changes to the Service and Terms

We may update the Service and these Terms over time. If changes are material, we'll notify you in the app or by email before they take effect. Continuing to use the Service after changes take effect means you accept the updated Terms.

14. Governing law

These Terms are governed by the laws of the State of California, without regard to its conflict-of-laws rules. Any disputes will be resolved in the state or federal courts located in San Francisco County, California, unless applicable law requires otherwise.
